    The Law and Legislative Committee is looking at a proposal to charge homeowners an annual fee of $25 if they encroach on Ninos Parkways. I realize that this will also apply to other parkways in the City but I have lived on the Ninos Parkway for about 25 years. I have no issue with the fee but do want to bring up some items that should be addressed before this goes to the City Council.
    Many of the old-timers have told me that when they bought their property, there was an agreement that they would be stewards of the Parkway and help maintain it. Many of the residents maintain the area behind their homes that include the parkway. This includes watering trees that were planted by the City but the irrigation system was shut down years ago. The City periodically mows the Parkway but many homeowners are the ones keeping the weeds down which reduces the chance of wildfires. Some residents bought their homes with the area on the parkway included in the description of the property. This is an issue that should be addressed.
    The issue of making sure the property is accessible to people on the parkway needs to be clarified. A tall wooden fence without a gate is different than short wire fences with gates that are not locked. I also know of one instance where an elderly couple found their backyard fence on fire due to a homeless camp on the parkway that started a fire right behind their yard. Neighbors put up a buffer fence to keep the couple safe; it is a wire fence with a gate that is locked. In each of these cases, decisions will have to be made on what counts as encroachment.
    The final issue is communication. I spoke to one man on the Parkway who got a notice on this issue. I never received a notice and none of the neighbors I talked to have gotten any sort of notice. The City needs to see the variety of issues that need to be addressed and clarified before putting a fee in place. We all want to work together to make sure the Parkway stays safe and is accessible. Thank you.
