My name is Joshua Jenkins and I am with Loyal Penguin, Inc.
The Labor Peace Agreement (LPA) is between two groups: Licensee and the Labor Organization; City is not mentioned in State code.
The Code only requires that licensees "attest" that they have a LPA on file. This applies to licensees that have Labor Peace Agreements established.
The Code continues to discuss, within the same definition (ยง26001; see "Labor Peace Agreement"), the ability to not have a LPA. In such circumstances, "the applicant shall provide a notarized statement indicating the applicant will enter into and abide by the terms of a labor peace agreement."
In other words, "A" LPA not yet in existence.
We request the City:
- Contact the State Labor Board and clarify the mandate for the existence of such a document
- Do not place additional, unnecessary burdens and barriers to entry that the State's Code does not require or necessitate.
